BackgroundInformed consent is a key element of ethical clinical research. Addicted population may be at risk for impaired consent capacity. However, very little research has focused on their comprehension of consent forms. The aim of this study is to assess the capacity of addicted individuals to provide consent to research.Methods53 subjects with DSM-5 diagnoses of a Substance Use Disorder and 50 non psychiatric comparison subjects participated in the survey from December 2014 to March 2015. This cross-sectional study was carried out (...) at a community-based Outpatient Treatment Center and at an urban-located Health Centre in Spain. A binary judgment of capacity/incapacity was made guided by the MacArthur Competence Assessment Tool for Clinical Research and a clinical interview. Demographics and clinical characteristics were assessed by cases notes and the Mini-Mental State Examination, the Global Assessment Functional Scale and the Clinical Global Impression Scale.ResultsNPCs performed the best on the MacCAT–CR, and patients with SUD had the worst performance, particularly on the Understanding and Appreciation subscales. 32.7 % SUD people lacked research-related decisional capacity. There were no statistically significant differences between the groups in terms of capacity to consent to research.ConclusionsThe findings of our study provide evidence that a large proportion of individuals with SUD had decisional capacity for consent to research. It is therefore inappropriate to draw conclusions about capacity to make research decisions on the basis of a SUD diagnosis. In the absence of advanced cognitive impairment, acute withdrawal or intoxication, we should assume that addicted persons possess decision-making capacity. Thus, the view that people with SUD would ipso facto lose decision-making power for research consent is flawed and stigmatizing. (shrink)

Recent research has found that the omission of accent marks in Spanish does not produce slower word identification times in go/no-go lexical decision and semantic categorization tasks [e.g., cárcel = carcel], thus suggesting that vowels like á and a are represented by the same orthographic units during word recognition and reading. However, there is a discrepant finding with the yes/no lexical decision task, where the words with the omitted accent mark produced longer response times than the words with the accent (...) mark. In Experiment 1, we examined this discrepant finding by running a yes/no lexical decision experiment comparing the effects for words and non-words. Results showed slower response times for the words with omitted accent mark than for those with the accent mark present, thus suggesting a bias toward a “word” response for accented items in the yes/no lexical decision task. To test this interpretation, Experiment 2 used the same stimuli with a blocked design and a go/no-go lexical decision task. Results showed similar response times to words regardless of whether the accent mark was omitted. This pattern strongly suggests that the longer response times to words with an omitted accent mark in yes/no lexical decision experiments are a task-dependent effect rather than a genuine reading cost. IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. O período da pandemia demarca um momento na história da educação brasileira que modificou os modos de trabalho e ao mesmo tempo, trouxe impactos na vida dos/as professores/as. Os resultados deste estudo, apontam para os impactos relacionados à saúde, como o mal-estar e a (...) síndrome de burnout fruto das condições de trabalho, como a intensificação e a precarização do trabalho ocasionadas pelo ensino remoto, alterando significativamente a vida destes profissionais. This paper examines the relation between the problem of human nature and political theory; it is claimed that every such theory is founded on some anthropological preconditions. The paper studies the political conceptions of four modern philosophers: Thomas Hobbes, Jean Jacques Rousseau, Karl Marx, Pyotr Kropotkin. It reveals that two opposing tendencies form the imaginary of the modern era: the authoritative one that identifies an egoistic/ unsociable human nature that needs control, and the libertarian one that recognizes a human being (...) capable of more advanced types of social fabric. The problem that is also investigated is how anthropological dualism can be transcended to permit the conception of a new anthropological type as well as the type of society that will help human potentiality of consciousness and coexistence to unfold. Este artículo analiza los aspectos centrales de la concepción del Estado en El Anti-Edipo. Capitalismo y esquizofrenia, en particular los desarrollos ofrecidos en el capítulo tercero: "Salvajes, Bárbaros, Civilizados". La innovadora figura del Estado surge de un juego polifónico, abigarrado, discontinuo y elíptico con Karl Marx a partir de la noción de Modo de producción asiático; con Friedrich Nietzsche considerando la noción de origen y domesticación; y con Sigmund Freud siguiendo la noción de latencia. Los rasgos centrales para su conceptualización (...) se sintetizan en: 1) El Estado despótico como momento paradigmático de todo Estado y 2) el Estado es entendido como máquina social, en su doble articulación: social y libidinal. The article analyzes the key aspects of the conception of the State in The Anti-Oedipus. Capitalism and Schizophrenia, in particular the developments offered in chapter three: "Savages, Barbarians, Civilized". The innovative idea of the State arises from a game polyphonic from the notion of Asian Production Mode, from the concept of origin and domestication, and from the notion of latency. The central features for conceptualization are summarized as follows: 1) The Despotic State as paradigmatic moment of every State and 2) the State is understood as a social machine, in its double articulation: social and libidinal. This volume broadens our concept of reasoning and rationality to allow for a more pluralistic and situational view of human thinking as a practical activity. Drawing on contributors across disciplines including philosophy, economics, psychology, statistics, computer science, engineering, and physics, _Reasoning, Rationality, and Probability_ argues that the search for strong theories should leave room for the construction of context-sensitive conceptual tools. Both science and everyday life, the authors argue, are too complex and multifaceted to be forced into ready-made schemata.

The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality and (...) famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. The starting point of this paper is that both J Rawls's work "A theory of Justice" and feminist theory have contributed greatly to the revival of the moral and political philosophy. My aim here is to show the relationships between Rawls's and feminist theories, and particularly to analyze feminist criticism of "justice as fairness" in the context of a more general study on contemporary theories of justice and on the relevance of justice in feminist theories.

Resumen: Si bien en Italia el debate sobre las clínicas jurídicas está en una fase inicial, cada vez hay un mayor número de universidades que están poniendo en marcha iniciativas vinculadas a tal fenómeno emergente. Ello permite plantearse nuevas cuestiones, en especial aquellas relacionadas con las clínicas, pero también es posible reconfigurar algunos de los temas “clásicos” y fundamentales de la filosofía del derecho. Este trabajo tiene como objetivo apuntar algunos de tales aspectos. Así tras una reconstrucción del marco general (...) del debate, me detendré sobre los temas principales de la experiencia clínica, esto es la formación del jurista y la tensión por alcanzar la justicia social. Abstract: Although the Italian debate concerning legal clinics is at the beginning, a growing number of Law Schools is starting to explore this approach to legal education. As a consequence, new topics specifically concerning legal clinics arise, while others – more “traditional” for legal-philosophical experts – need to be reconfigured and re-articulated. This essay aims at addressing some of the latter aspects: once the terms of the debate have been reconstructed, I will consider two of the main topics of the clinical experience, namely the jurist’s formation and the tension towards social justice outcomes. RESUMEN: En su Teoría de los Sentimientos Morales Adam Smith propone una ética que concilia dos paradigmas habitualmente considerados como incompatibles: una ética de virtudes, con normas orientativas e ideales de excelencia, y una ética con reglas universales que se aplican en todos los casos sin excepción. Smith lo hace cambiando el punto de vista desde el que se realiza el juicio moral, a una perspectiva que llamaré "simpatético-imparcial", y que corresponde a "los sentimientos simpatéticos de un espectador imparcial y (...) bien informado". Este novedoso punto de vista le permite introducir características modernas a la ética clásica de la virtud para dar una nueva justificación a las virtudes positivas, así como cambiar el modo de entender las "reglas o principios universales". De este modo, Smith construye una ética capaz de dar cuenta, dentro del mismo marco teórico, tanto de los ideales de excelencia propios de la virtud, como de los imperativos universales modernos. ABSTRACT: In his Theory of Moral Sentiments, Adam Smith reconciles two moral paradigms that are usually considered incompatible: an ethics of virtue, with general guidelines and ideals of excellence, and an ethics with universal rules, which must be applied to all cases without exceptions. Smith makes this possible by shifting the perspective from which moral judgments are assessed to what I call the 'sympathetic-impartial' perspective, which stands for "the sympathetic feelings of an impartial and well-informed spectator". From this new standpoint, Smith is able to introduce some modern features into classic virtue ethics and provide a different justification for positive virtues, as well as to change the way 'universal norms or principles' are understood. Accordingly, Smith's theory accounts simultaneously, and within the same theoretical framework, for both ancient-like virtues and their ideals of excellence and for modern-like universal imperatives. It is no coincidence that the relationship between Paul Ricoeur and Michel Foucault has been principally discussed in research carried out by specialists in one of these two thinkers. Although active at the same time, the scholar can easily get the impression that they worked in two parallel philosophical universes. This paper will argue, however, that a comparative reading is nonetheless possible. Taking identity and the subject as key areas of discussion, as well as the methodology used to deal with (...) these themes, this paper will highlight the continuities between both the philosophers’ world views. A reading of their post-1980 works makes it clear that both of them, each in his respective way, can enrich a reading of the other and that, more than just being contemporaries, they share several important points in common. The scientist Richard Lovell Edgeworth, educated at Trinity College, Dublin, and Oxford, was a Member of the Lunar Society of Birmingham, where he exchanged ideas with other scientists, including James Watt, and was known for his significant mechanical inventions. However, Edgeworth's real interest was education: in this 1788 two-volume work, written with his daughter, the poet Maria Edgeworth, he draws on his own experience of raising twenty children, from which the work derives its authority and innovative character. The work was (...) very influential, and led to his Essays on Professional Education. The two volumes discuss the theories of philosophers and educationalists, while in general arguing for the importance and formative character of early childhood experiences. Utilizando as categorias do liberalismo historicista, de matriz inglesa, e as do radicalismo libe­ral, de coloração racionalista à francesa, procuramos demonstrar como o liberalismo vintista se estabelece entre o balanceamento dos dois modelos. A teoria do municipalismo, levada a cabo por Alexandre Herculano, mais não faz do que elevar ao nível da conceptualização (...) uma consciência que os "corpos intermédios" manifestaram na adesão ao vintismo, quando a ideia da "soberania da Nação" tendia a afirmar-se como absoluta. Après le Concile de Trente on assiste, dans les cités italiennes et dans les états du pape, à une marginalisation croissante des prostituées qui sont à le fois cantonnées et taxées, écartées et intégrées. Pourtant ce ne sont pas des conduites sexuelles scandaleuses qui en font, de plus en plus, un gibier d’inquisition. En fait le Saint Office s’intéresse aux incantations, conjurations et oraisons « pour l’amour » qui semblent être un savoir spécifiquement lié au métier. L’article, fondé principalement sur (...) le fonds inédit de l’inquisition de Modène, met en évidence, grace à l’extrême minutie du dialogue inquisitorial, la complexité culturelle de ce savoir – entre oral et écrit, entre manuscrit et imprimé – et son lien à la performance rituelle dont les prostituées sont reconnues comme les seules officiantes efficaces. C’est dans l’ambivalence – sociale, culturelle et symbolique – des prostituées que s’enracine leur pouvoir d’intermédiaires que les oraisons incarnent dans un panthéon des médiatrices de l’amour (Vierge, Sainte Marthe, Diane, Sybille). Par le prisme de la scène-paysage, l’article engage une réflexion sur les possibles conceptions d’une scène non anthropocentrique, en visitant des spectacles de Robert Wilson, Claude Régy et Maguy Marin. Ni décor pour les personnages ni fond de scène pour les acteurs, le paysage, caractérisé par la ligne d’horizon qui l’unifie (...) et par son absence de centre, nous inciterait à penser la scénographie en lien direct avec l’activité cognitive du spectateur et, plus précisément, avec l’expérience du regard. In this paper, we seek to understand the psychology and cognitive strategies of people with the psychological profile of authoritarian leaders. To understand their personality traits, we compare them with literature concerning successful psychopaths. We also see both personalities in the light of literature in the field of self-help for success in business. We say these psychological profiles are shaped by culture, as self-help literature shows. Our intention in comparing successful psychopaths and authoritarian leaders is not to reinforce the idea (...) that authoritarian leaders are unemotional, but rather the opposite. We wish to explore this relationship from the perspective of embodied cognition, according to which emotions are a fundamental part of decision-making, including political decision-making. Traditionally, both successful psychopaths and authoritarian leaders are understood as unemotional and therefore completely rational: here we explore the idea that this apparent rationality hides a particular emotional profile and a certain stubbornness and impulsivity regarding previously set goals. Also, as self-help literature reveals, set goals are closely associated with their identity, so that compromise regarding goals is seen as a loss of said identity. The study of the authoritarian leader as a gnoseological category helps us think about the relationship between volition, rational thought, identity, and emotions in decision-making; and to understand the way of acting of authoritarian leaders, and the way they succeed and fail. Partiendo de la recurrencia del motivo de la pobreza de la experiencia en el marco de la Teoría crítica y su entorno más afín, nos proponemos tematizar la equivocidad que presenta el mismo mediante la delimitación de sus diferentes sentidos en Adorno, Horkheimer y Benjamin. Ello nos permitirá dejar esbozadas las líneas generales de una problemática que, a nuestro entender, es producto de cierta complementariedad pero a la vez tensión entre dichos sentidos.
